These Terms & Conditions govern participation in and use of Chef Share, including the Chef Share website, application process, and Founding Cape Cod Pilot.
By applying to participate in Chef Share, accessing Chef Share services, or using the platform, you agree to these Terms & Conditions.
1. About Chef Share
Chef Share is being developed to help hospitality businesses and culinary professionals connect around available work opportunities. Chef Share is currently operating as a limited pilot program on Cape Cod, Massachusetts.
Features, procedures, eligibility requirements, and program rules may change as the pilot is tested and improved.
2. Eligibility
Participants must be at least 18 years old and must provide accurate information when applying or participating.
Chef Share may review applications and may approve, decline, suspend, or remove participants from the pilot when reasonably necessary for the operation, safety, or integrity of the program.
3. Culinary Professional Responsibilities
Culinary professionals are responsible for providing accurate information regarding their experience, qualifications, certifications, credentials, availability, and ability to perform a particular shift.
Participants are responsible for reviewing the requirements of a work opportunity before accepting or confirming it.
4. Business and Organization Responsibilities
Participating businesses and organizations are responsible for accurately describing available shifts, including job duties, location, schedule, compensation, workplace expectations, and any required qualifications or credentials.
Businesses are responsible for maintaining a safe and lawful workplace and for complying with applicable employment, wage, workplace safety, tax, licensing, and other legal requirements.
5. Work Arrangements and Compensation
Chef Share facilitates connections between participating businesses or organizations and culinary professionals.
Unless Chef Share expressly states otherwise in a separate written agreement, compensation for a shift is arranged directly between the participating business or organization and the culinary professional.
Chef Share does not currently process wages through the Chef Share platform.
The legal classification, employment relationship, payment obligations, tax responsibilities, insurance requirements, and other legal obligations associated with a particular work arrangement are determined by applicable law and the parties involved.
Nothing presented through the current Chef Share pilot should be interpreted as creating a specific employment, staffing, contractor, agency, partnership, or joint-employment relationship unless separately established in writing and permitted by law.
6. Shift Information and Confirmation
Participants should review all shift information carefully before confirming participation.
A shift may include information such as job duties, date, time, location, compensation, required credentials, dress or equipment expectations, and other workplace requirements.
Chef Share may record application, acceptance, confirmation, cancellation, check-in, completion, and similar participation information to help operate and evaluate the platform.
7. Cancellations and No-Shows
Participants are expected to communicate promptly when they are unable to fulfill a confirmed shift.
Chef Share may record cancellations, no-shows, or similar reliability information for internal administration, safety, dispute resolution, and platform improvement.
Any financial consequences associated with cancellations or missed shifts will only apply when lawful and when clearly communicated under applicable terms or agreements.
8. Credentials and Trust Information
Chef Share may allow participants to provide certifications, credentials, professional experience, references, vouches, confirmations, or post-shift feedback.
Chef Share may review or verify certain information, but does not guarantee the accuracy of every representation made by a participant.
Businesses and culinary professionals remain responsible for making their own decisions regarding whether to work with another participant.
9. Professional Conduct
Participants are expected to use Chef Share professionally and lawfully.
Participants may not knowingly provide false information, harass others, misuse personal information, interfere with the platform, impersonate another person or organization, or use Chef Share for unlawful purposes.
10. Safety and Emergencies
Chef Share is not an emergency service.
Immediate workplace emergencies should be handled through the appropriate business management, emergency services, law enforcement, or other appropriate authorities.
11. Pilot Program
Chef Share is in active development. During the Founding Pilot, features may be changed, added, limited, suspended, or removed as the service is tested.
Participation in the pilot does not guarantee continued access to future versions of Chef Share.
12. Availability of Service
Chef Share will make reasonable efforts to operate the service reliably but cannot guarantee uninterrupted access or that every shift will be filled.
13. Limitation of Responsibility
To the extent permitted by law, Chef Share is not responsible for the independent actions, representations, workplace conditions, performance, or conduct of participating businesses, organizations, or culinary professionals.
Nothing in these Terms is intended to waive rights or protections that cannot lawfully be waived.
14. Privacy
Information collected through Chef Share is handled according to the Chef Share Privacy Policy.
15. Changes to These Terms
Chef Share may update these Terms & Conditions as the pilot develops or as legal and operational requirements change.
The effective date will be updated when material revisions are made.
